Summary
The purpose of the Protection of Personal Information Act (POPIA) is to protect people from harm by protecting their personal information. To stop their money from being stolen, to stop their identity from being stolen, and generally to protect their privacy , which is a fundamental human right.
Full policy
To achieve this, the POPIA sets conditions for when it is lawful for someone to process someone else’s personal information. According to POPIA, personal information is information relating to an identifiable, living, natural person and, where applicable, an identifiable, existing juristic person. A juristic person includes a company, trust, or close corporation.
Thus, any personal information that a company collects and processes, for example, and where information can be linked to a natural or juristic person (referred to as data subjects), must meet the requirements for processing personal information. Information that identifies a natural or juristic person could be as simple as a name in conjunction with a cell phone number or it can be more complex, such as an IP (Internet Protocol) address or cookie identifier. To protect privacy, responsible parties that collect and process personal information should inform data subjects beforehand of the purpose for which personal information will be collected and reassure the data subjects that their information is safe and secure and will be used only for a specific purpose consented to.
The POPI Act does not stop or prevent anyone from processing personal information and does not require everyone to get consent from data subjects to process their personal information. Whoever decides why and how to process personal information is responsible for complying with the conditions laid out in the Act, however, there are penalties and fines for offenses and noncompliance against the Act. It is important to consider that privacy means different things to different people therefore one needs to tread carefully as it is a fundamental human right. Generally, privacy protection is keeping the information you’d like to keep to yourself from getting into the hands of companies, hackers, government organizations, and other groups. Each person has different expectations of privacy, so the level of security they need to feel that their privacy is truly protected ranges greatly.
